BUYER’S PREMIUM: 5% Buyer’s Premium – The 5% will be added to the high bid to determine the Contract Sales Price.
Brokers who represents the purchaser(s) will receive a 5% commission of the Contract Sales Price at closing. If closing does not take place, the brokers are not owed any commissions.
CONTRACT AND PAYMENT TERMS: Immediately following the ending of the Auction, the Auction Company will email a Sales Contract to the successful bidders. Each successful bidder will be required to sign the Sales Contract and return it within 24 hours of receiving the Contract. The successful bidder(s) will also be required to submit their Earnest Money Deposit within 48 hours of the close of the Auction.

PAYMENTS: Payments are accepted by Cash, Cashier’s Check, Wire Transfer, or Visa/MasterCard/ Discover. Bidders paying with a credit card will be charged an additional 3% surcharge, in addition to the Buyer’s Premium.
BIDDING: Please do not enter a bid on an item, if you do not feel comfortable with the item based on its condition. Auctioneer is not responsible for a bidders inability to place any bid, internet or otherwise for this Auction for any reason. In the event of technology issues with Internet sales, the Auctioneer reserves the right to reopen or extend Internet bidding as it deems necessary and appropriate.
WARRANTY: All properties are sold “AS-IS”, “WHERE-IS”, with no warranties or guarantees. THERE WILL BE NO ADJUSTMENTS TO THE FINAL BID PRICE AFTER THE BIDDING CLOSES. This information is only a guide and is not a warranty or guarantee, actual or implied. ADDITIONAL TERMS & CONDITIONS OF SALE:
1. BIDDING: Bidding is open to the public without regard to race, color, sex, religion, or national origin. All bidders are required to have a bidder’s number to bid. To obtain a bidder’s number, a registration form must be filled out including full name, address, phone number, and other information, including valid credit card information.
2. BIDDING PROCEDURES: (1) Method, order of sale, and bidding increments shall be at the sole discretion of the Auctioneer. (2) The Auctioneer reserves the right to delete or add lots at its discretion.
3. BID EXECUTION: Auctioneer is not responsible for a bidders inability to place any bid, internet or otherwise for this Auction for any reason. In the event of technology issues with Internet sales, or for other reasons, the Auctioneer reserves the right to reopen or cancel Internet bidding as it deems necessary.
4. DEFINITIONS: Purchaser is the highest bidder whose bid has met the Minimum Bid Amount and is accepted by Auctioneer, (“Purchaser”). The “Final Bid” shall be the Purchaser’s bid as accepted by the Auctioneer, and all items are “Purchased” when the Purchase Price is accepted.
5. INFORMATION: The information has been prepared only as a guide based on information from sources believed to be reliable, but the accuracy thereof cannot be guaranteed or warranted by Walker.
6. CLOSING: The subject properties will be conveyed by Special Warranty Deeds and the closings will take place on or before December 20, 2017.
7. DEFAULT BY PURCHASER: In the event Purchaser fails to sign the Sales Contract, pay the Earnest Money Deposit, as described herein or fails to close within the allotted time, will be considered to be in “Default”. Bidders, please be aware, in the case of “Default” the seller will have any and all legal recourse to collect the monies, as permitted under the Laws of the Commonwealth of Virginia.
8. ACCEPTANCE AND AGREEMENT: Registration and bidding on these properties this Auction, automatically implies an understanding of all legal obligation to the Terms and Conditions of this Auction.

10. Surveys for Poplar Grove are on our available for downloading/viewing, however, the actual “to-scale” surveys are in our office. Upon request, we can mail them to you at no charge or USP Express them to you for $15.00.
11. All property lines have been marked by the Auction Company and deemed to be close to actual surveys, however, all buyers must rely on their own interpretations of the lines before placing bids on the properties.
