Basic Terms and Conditions:
1. REGISTRATION: Bids accepted only from registered bidders. Bring driver’s license for identification. A Cashier’s Check in the amount of $30,000.00 for the Commercial Building and 10% of the bid on the Townhouse Units and Development Parcels is required for registration.
2. DEPOSIT: The successful bidder will be required to sign a Memorandum of Sale immediately after the hammer falls with the Trustee. A deposit of $30,000.00 for the Commercial Building and 10% of the High Bid Price for the Townhouse Units and the Development Parcels is required and will be held by the Substitute Trustee to be applied to the purchase price at closing. Deposits are Non-Refundable.
3. CLOSING: Closings are to take place within 30 days of sale - Time will be of the Essence.
4. DEED: Property to be conveyed by Special Warranty Deed. Property being sold by Substitute Trustee, pursuant to terms of Deed of Trust.
5. “AS-IS”, “WHERE-IS”: Property will be sold “AS-IS”, “WHERE-IS”. Potential Buyers must perform such independent investigations with respect to property as they deem necessary to verify information provided by Auction Company or Substitute Trustee.
6. ANNOUNCEMENTS: Announcements made on the day of sale take precedence over all prior releases, both verbal and written, concerning this sale or property.
7. WARRANTY: All information provided by Auction Company and Substitute Trustee is deemed reliable but is not warranted. The information contained in this brochure and any advertisements by Auction Company or Substitute Trustee are subject to verification by all parties relying on it. No liability for its accuracy, error or omission is assumed by the Auction Company and Substitute Trustee.
8. REPRESENTATION: Auction Company and its representatives represent the Seller.
9. BUYER’S PREMIUM: There is a 5% Buyer’s Premium in effect on day of sale. The Buyer’s Premium is added to the high bid amount, to determine the Contract Sales Price.
10. BID INCREMENTS: Auctioneer reserves the right to set bid increments.
